In order to provide our customers with the best experience while using our products we highly welcome and encourage feedback. By doing so we will be able to continue to improve on delivering our customers with exceptional standards of service as well as continue to maintain a high level of quality of our products. We also reward our customers who leave reviews and/or share them regardless of the sentiment by providing them with a 10-15% off discount coupon redeemable upon their next purchase post leaving their review.

Negative Reviews

Consistent with our policy for responding to online reviews, we will handle any communications with reviewers about their reviews individually by phone or email. Any concerns raised in the review will be handled in the same manner as our existing policies for handling concerns that are made known to us through other means. For negative reviews received on our website and/or SEC-compatible platforms where we solicit and promote reviews, we will use the additional disclosures field accompanying the review to document our perspective on any concerns raised.

Handling Spam and Inappropriate Content

Our policy for handling online reviews which are spam or include inappropriate content is based upon the Consumer Review Fairness Act of 2016, which states that as a business, we have the right to remove a review from our website (and/or request the removal of reviews about our business on third party websites) that: 

contains the personal information or likeness of another person, or is libelous, harassing, abusive, obscene, vulgar, sexually explicit, or is inappropriate with respect to race, gender, sexuality, ethnicity, or other intrinsic characteristic;
 is unrelated to the goods or services we offer;

contains trade secrets or commercial or financial information obtained from a person and considered privileged or confidential;

content that contains any computer viruses, worms, or other potentially damaging computer code, processes, programs, applications, or files.

 If we receive a review on our business website that is clearly spam, we will delete it with no further action taken. Otherwise, in situations where the reviewer is known to us and/or provides valid contact information, we will contact the reviewer (usually by phone or email) to notify them of our policy and our resulting actions. For reviews we receive on unaffiliated third-party websites, we will also contact the review platform and follow their procedures to request appropriate action be taken consistent with our policy.

The Motif Medical mobile message service (the "Service") is operated by Motif Medical (“Motif Medical”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Motif Medical’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Motif Medical through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Motif Medical. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18557730701 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Motif Medical mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the“Motif Aura” mobile application (“Mobile Application” or “Service”) and any of its related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you” or “your”) and Motif Medical LLC (“Motif Medical LLC”, “we”, “us” or “our”). If you are entering into this agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such an entity to this agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this agreement, you must not accept this agreement and may not access and use the Mobile Application and Services. By accessing and using the Mobile Application and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and Motif Medical LLC, even though it is electronic and is not physically signed by you, and it governs your use of the Mobile Application and Services.

Limitation of liability

To the fullest extent permitted by applicable law, in no event will Motif Medical LLC, its affiliates,directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect,incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability,including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise,even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of MotifMedical LLC and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount no greater than one dollar or any amounts actually paid in cash by you to Motif Medical LLC for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

Indemnification

You agree to indemnify and hold Motif Medical LLC and its affiliates, directors, officers, employees,agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs,including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Mobile Application and Services or any willful misconduct on your part.

Changes and amendments

We reserve the right to modify this Agreement or its terms related to the Mobile Application andServices at any time at our discretion. When we do, we will revise the updated date at the bottom of this page. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.

An updated version of this Agreement will be effective immediately upon the posting of the revisedAgreement unless otherwise specified. Your continued use of the Mobile Application and Services after the effective date of the revised Agreement (or such other act specified at that time) will constitute your consent to those changes.

Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. Byaccessing and using the Mobile Application and Services you agree to be bound by this Agreement.
